Neither party shall be liable for the disclosure of confidential information to the other where, as evidenced by clear and convincing evidence, the confidential information is known to the public at the time of disclosure by the disclosed party; (b) is known to the public through no fault of the receiving party; or (c) was lawfully owned by the receiving party prior to the signing of this agreement; or (d) is subject to applicable U.S. laws or a valid court order that requires disclosure of such confidential information. Customers should use service contracts when using a service provider to perform paid work in order to define the exact details of the agreement, including remuneration, obligations and confidentiality, if necessary. . . .
